Mirena IUD lawsuit claims continue to mount in a Multicounty Litigation now underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to a new Case List issued by the Court on July 9th, at least 170 Mirena lawsuits are currently pending in the New Jersey proceeding. Mirena IUD Lawsuits
All of the Mirena lawsuits pending in the New Jersey litigation allege Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of serious complications associated with spontaneous migration of the device. Court documents indicate that nearly 50 additional Mirena lawsuits involving similar allegations have been filed in a multidistrict litigation now underway in the U.S. District Court, Southern District of New York. Unlike a Mirena class action lawsuit, all of these claims will maintain their individual identity.
The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a birth control method in 2000. According to a recent report from NewsChannel5 in Cleveland, Ohio, Mirena is now used by more than two million women in the U.S. However, the same report revealed that the FDA has received more than 70,000 Mirena side effects reports since the IUD was first brought to market. Since 2008, the agency logged more than 4,700 complaints of device dislocation involving Mirena, and 1,300 reports of uterine perforations.*
According to court documents, plaintiffs in Mirena lawsuits allege Bayer has a history of overstating the efficacy of Mirena and understating its risks. In 2009, FDA issued a warning letter that raised similar concerns about one of Bayer’s Mirena promotional campaigns. Among other things, the letter cited Bayer for making statements that indicated Mirena would help a woman “look and feel great,” and improve her sex life.**
