Federal Court Appoints Onder Law Firm Partner as Co-Lead Counsel to the Plaintiffs' Steering Committee of the Multi-District Litigation for Yasmin and Yaz Litigation

Mark Niemeyer, a partner at Onder, Shelton, O’Leary & Peterson, LLC, has been appointed to the Plaintiffs' Steering Committee in the consolidated Yasmin and Yaz birth control litigation.

St. Louis, MO (November 12, 2009) – Mark Niemeyer, a partner with Onder, Shelton, O’Leary & Peterson, LLC, was appointed by U.S. District Judge David R. Herndon, who is presiding over the federal litigation for Yaz and Yasmin birth control (MDL No. 2100) in the U.S. District Court for the Southern District of Illinois, as Co-Lead Counsel to the Plaintiffs’ Steering Committee. In an order issued November 10, Judge Herndon appointed a group of 14 attorneys to serve in act as the spokespersons for all plaintiffs at pretrial proceedings and in response to inquiries from the court. They will also submit and argue motions before the court, examine witnesses at hearings and negotiate stipulations and potential settlements with the defendants, which would apply to all Yasmin and Yaz lawsuits against Bayer Healthcare Pharmaceuticals.

Andres F. Alonso, of , Great Neck, NY, Michael S. Burg, of Englewood, CO, and Michael London, of New York, NY, will serve as Co-Lead Counsel with Mark Niemeyer. Other members of the Plaintiffs’ Steering Committee include Daniel Becnel, A.J. DeBartolomeo, Thomas Girardi, Arnold Levin, Jeff Lowe, Roopal R. Luhana, Steven Maher, Trent Miracle and Mark Robinson. “My role in this MDL is simply a reflection of the commitment of all of us at Onder, Shelton, O’Leary & Peterson, LLC to the women or families of women who suffered grave health consequences after taking Yaz or Yasmin and just how seriously we take all of our cases,” said Mr. Niemeyer.

Yasmin and Yaz, the best selling oral contraceptive in the U.S., contain a type of progestin known as drospirenone. Most Yaz legal complaints against Bayer Healthcare Pharmaceuticals, Inc. cite drospirenone as the cause of serious and life threatening health problems such as blood clots, stroke, heart attack, deep vein thrombosis and gallbladder disease.

In October, all federal Yasmin and Yaz lawsuits were centralized before Judge Herndon in the U.S. District Court for the Southern District of Illinois as part of an MDL, or multidistrict litigation. Currently there are more than 125 lawsuits filed by women who have experienced serious health problems after taking Yaz or Yasmin.
