Byetta Lawsuit News: Bernstein Liebhard LLP Awaits Decision on Establishment of Federal Multidistrict Litigation for Byetta Pancreatic Cancer Claims

On March 14, the U.S. Food & Drug Administration (FDA) announced it was investigating findings from an unpublished study that suggested Byetta and other incretin mimetics could be associated with pre-cancerous cellular changes in the pancreas called pancreatic duct metaplasia.* The month prior, a paper published in JAMA Internal Medicine reported that drugs like Byetta appeared to double the risk for pancreatitis, a known risk factor for pancreatic cancer.** A year earlier, research published in Gastroenterology found that Byetta increased the risk of pancreatic cancer by nearly 3-fold. The same study also reported 30 cases of thyroid cancer in patients taking the drug, and a six-fold increase risk for pancreatitis among Byetta users.***

According to Bernstein Liebhard LLP, multidistrict litigations like that proposed for Byetta lawsuits are established when a large number of complex cases share common allegations of facts. The aim of such a proceeding is to preserve the resources of the Court, parties and witnesses, and to avoid duplicative discovery and conflicting orders.
