$4 Billion DePuy ASR Hip Recall Lawsuit Settlement Reportedly Agreed to by Johnson & Johnson Reports Wright & Schulte LLC

According to court documents, DePuy ASR Hip Recall Lawsuit filed since the recall allege that the device was defectively designed, and that patients and the medical community weren’t adequately warned of its risks. DePuy ASR Hip Recall Lawsuit Plaintiffs further allege that metal particles released due to wear of the hip’s metal components can cause metallosis, pain, swelling, chromium and cobalt poisoning, and other serious complications.

According to Bloomberg News, the proposed DePuy ASR Hip Recall Lawsuit settlement would resolve about 7,500 of 12,000 claims pending against Johnson & Johnson and its DePuy Orthopaedics unit. Remaining DePuy ASR Hip Recall Lawsuit claims, which were filed by people who are worried they may suffer complications that could lead to revision surgery in the future, will be subject to a second round of settlements.

According to court records, the nation’s first DePuy ASR hip recall trial ended in March in California, as the plaintiff prevailed and was awarded more than $8 million. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, the companies scored a victory in a second trial that concluded a month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County, Illinois). The first trial in the federal litigation underway in Ohio was supposed to begin in September, but was postponed. (McCracken v. DePuy, 11-dp-20485, U.S. District Court, Northern District of Ohio (Toledo))
