Fall Zeltiq - CLINIPRO: Gericht entscheidet LipoCryo-Klage zugunsten von Clinipro

CLINIPRO, ein spanischer Hersteller von medizinisch-ästhetischen Geräten, gibt bekannt, dass das Handelsgericht Nr. 5 Barcelona einen Beschluss angeordnet hat, der auf den 25. Januar 2013 datiert ist und der die von Zeltiq Aesthetics Inc. (Nasdaq: ZLTQ) und dem Massachusetts General Hospital (MGH) angestrengte Klage gegen CLINIPRO wegen angeblicher Patentverletzungen und illoyaler Kompetenzhandlungen vollständig abgewiesen wird. Der Fall wurde von der Kanzlei SOL MUNTAÑOLA & ASOCIADOS übernommen, die von CLINIPRO zur Abwicklung der Rechtsangelegenheit beauftragt worden war.

Das Urteil besagt, die Patente der Kläger werdenaufgrund des Mangels an erfinderischer Tätigkeit (das Verfahrenspatent) und des Mangels an Neuerungen (das Gerätepatent) aufgehoben, weshalb die eingereichte Klage abgewiesen werde. Darüber hinaus weist das Urteil die Existenz von illoyalem Verhalten, die ebenfalls Teil der Klage war, unter anderem deshalb ab, weil Zeltiq und das MGH sich nicht den Name der Technik zu eigen machen können, die das Kälteverfahren zur Fettreduzierung beschreibt (Cryolipolyse). Gemäß dem Urteil müssen Zeltiq und das MGH die entstandenen Kosten tragen, wobei CLINIPRO die Möglichkeit in Betracht zieht, auf Schaden- und Aufwendungsersatz zu klagen.

Es muss daran erinnert werden, dass aufgrund der von dem MGH und von Zeltiq eingereichten Klage gegen CLINIPRO wegen Urheberrechtsverletzungen am 5. Mai 2012 ein vorläufiger Beschluss angeordnet worden war, in dem Vorsichtsmaßnahmen gegen die Vermarktung von LipoCryo in Spanien festgelegt wurden. Später wurde dieser Beschluss in einem Urteil vom 25. Juni 2012 für nichtig erklärt, wobei sich das Gericht mit der Hinterlegung einer substitutiven Kaution einverstanden er
